Mesothelioma is caused by exposure to asbestos. Asbestos is a compound that is used in many products such as roofing material, tires, flooring, textiles, insulation and roof shingles. Despite its usefulness in insulation, this compound has the potential to cause serious health issues once ingested or inhaled. In fact, the Environmental Protection Agency (EPA) went so far as to ban products containing asbestos back in 1989.

Asbestos & Mesothelioma

Asbestos is made up of microscopic fibers that can get dislodged by wear and tear, or due to elements such as the wind and sun. These fibers then travel airborne, landing on a person’s garments or skin. They are also inhaled or can be ingested. Additionally, individuals who are exposed to asbestos may put their families at risk because they may carry these fibers back home from work on a daily basis. These fibers are sharp and jagged; and have the potential to move to certain areas of the body such as the lungs and stomach, causing adverse reactions (such as asbestosis and mesothelioma cancer) over a period of time.

The body cannot break these microscopic fibers down once they get inside an individual. With time, a person may develop a dry crackling sound when inhaling or a persistent cough. This could be symptomatic of asbestosis, a condition that can become fatal or disabling as it progresses. Asbestosis may not cause cancer; however, it is usually chronic and may require long term care. Because asbestosis may take time to manifest symptoms, most people have no idea that it may have developed as a result of working with, or near, products containing asbestos.

Mesothelioma

Another more serious condition caused by asbestos exposure is mesothelioma. This is a rare form of cancer that affects various areas such as the lining of the abdomen, chest, or (more frequently) the lungs. On rare occasions, it may also affect the heart.

Mesothelioma usually affects people who come into close contact with asbestos. This may include employees of asbestos mills, factories, and mines as well as those who work in industries that manufacture asbestos insulation. Navy shipyards and manufacturers of insulated materials are a common source of this exposure.

Mesothelioma – Caused by Asbestos Exposure

There are three different categories of mesothelioma cancer:
  • Pleural mesothelioma (affects the lungs).
  • Peritoneal mesothelioma (affects the stomach).
  • Pericardial mesothelioma (affects the heart).

Some of the symptoms of pleural mesothelioma include:
  • Chest pain
  • Persistent coughing
  • Fatigue
  • Fever
  • Weight loss
  • Fluid buildup

Peritoneal mesothelioma symptoms include:
  • Unexplained abdominal pain
  • Weight loss
  • Fatigue

Pericardial mesothelioma accounts for less than 1 percent of all mesothelioma diagnoses. Here are a few symptoms you need to keep an eye out for:
  • Irregular heartbeat.
  • Pericardial bleeding.
  • Difficulty breathing.
  • Fluid buildup.

It may be possible for doctors to misdiagnose pericardial mesothelioma as myocarditis and pericarditis. Because of this, it’s important to mention to your doctor that you may have been exposed to asbestos.

You and your family may be eligible for compensation.

What is Asbestos?

Asbestos is a fibrous mineral and element that has both unique insulating and fire-retardant properties. These special properties have made asbestos a key component in a wide variety of construction materials and other industrial products.

Asbestos is a group of minerals that occur naturally as bundles of fibers. There are 2 main types of asbestos fibers: The most common asbestos in industrial use, known as chrysotile, or white asbestos, has curly fibers. Amphibole asbestos fibers are straight and needle-like. There are several types of amphibole fibers, including amosite, crocidolite, tremolite, actinolite, and anthophyllite.

Amphiboles (particularly crocidolite) are considered to be more likely to cause cancer, but even the more commonly used chrysotile fibers have been linked to cancer.
Where is Asbestos Found?

Asbestos was found in many products and it was also commonly used in many construction products for industrial and commercial applications, mainly in manufacturing plants, refineries, and shipyards.
Who is at Risk for Developing Asbestos Related Disease?

People are exposed to asbestos mainly by inhaling fibers in the air they breathe. This may occur during mining and processing asbestos, making asbestos-containing products, or installing asbestos insulation. It may also occur when older buildings are demolished or renovated, or when older asbestos-containing materials begin to break down. People most at risk for developing mesothelioma or other asbestos-related illnesses include workers whose jobs directly expose them to asbestos fibers.

The people with the heaviest exposure are those who worked in asbestos industries, such as shipbuilding and insulation. Many of these people recall working in thick clouds of asbestos dust, day after day. Family and friends of these workers are also at risk due to "household exposure." There are cases of spouses and children of workers who develop asbestos-related illnesses like mesothelioma as a result of second-hand exposure to their spouse or parent who was directly or indirectly exposed to asbestos.

Why is Asbestos Harmful?

Asbestos fibers produce dust. When inhaled, asbestos dust forms deposits in the lungs that can cause illnesses include mesothelioma, lung cancer, and asbestosis. Workers exposed to asbestos from the 1940s through the 1970s continue to develop mesothelioma, lung cancer, and asbestosis after a very long latency period.

Several federal and state agencies have the authority to regulate asbestos. These agencies include the U.S. Department of Labor/Occupational Safety and Health Administration (OSHA) and the U.S. Environmental Protection Agency (EPA).

Diseases Related to Asbestos Exposure
Several diseases are common among workers or family members exposed to asbestos. These are malignant mesothelioma, lung cancer, and asbestosis.
Malignant Mesothelioma

Malignant mesothelioma is an extremely aggressive cancer. Asbestos exposure is the only known cause of this terminal illness. The three types of malignant mesothelioma are Epithelioid, Sarcomatoid, and Mixed type.

Lung Cancer
Asbestos exposure is known to cause lung cancer. The combination of asbestos exposure and cigarette smoking is especially deadly. Scientific studies published by the U.S. Surgeon General indicate that people who smoke and were exposed to asbestos on the job are 90 times as likely to develop lung cancer as people who smoke but were never exposed to asbestos.
Asbestosis

Asbestosis is a lung disease caused by inhaling asbestos dust. The disease produces inflammation and scarring (fibrosis) of the lung.

Medical Studies and Research Lung Cancer

Inhalation of asbestos fibers has been linked to an increased risk of lung cancer in many studies of asbestos-exposed workers. In general, the greater the exposure to asbestos, the higher the risk of lung cancer. Most cases of lung cancer in asbestos workers occur at least 15 years after initial exposure to asbestos. In workers exposed to asbestos who also smoke, the lung cancer risk is much greater than even adding the risks from these exposures separately.
Mesothelioma

A mesothelioma is a rare form of cancer that affects the thin membranes lining organs in the chest (pleura) and abdomen (peritoneum). Mesothelioma is closely linked with asbestos; most cases of mesothelioma result from direct exposure to asbestos at work.

Studies have found an increased risk of mesothelioma among workers who are exposed to asbestos, as well as among their family members and people living in the neighborhoods surrounding asbestos factories and mines.

Mesotheliomas typically take a long time to develop. The time between first exposure to asbestos and diagnosis of mesothelioma is usually 30 years or more. Unfortunately, the risk of mesothelioma does not drop with time after exposure to asbestos. The risk appears to be lifelong. Unlike lung cancer, mesothelioma risk is not increased among smokers.

Asbestos and other health problems

The major health problem caused by asbestos exposure is a lung disease called asbestosis. When a person breathes high levels of asbestos over time, some of the fibers lodge deep in the lungs. Irritation caused by the fibers eventually leads to scarring (fibrosis) in the lungs. This can make it hard to breathe. The main symptoms of asbestosis are shortness of breath and a chronic cough.

When asbestosis occurs, it is typically 10 to 20 years after the initial exposure to asbestos. The disease can get worse over time. While some people may not have serious symptoms, others may be seriously disabled by breathing problems. Unfortunately, there is no effective treatment for this disease.

Asbestos can also reach the outer lining of the lungs (pleura), where it can cause pleural plaques (areas of hard, scar-like tissue in the pleura), pleural thickening, and pleural effusions (buildup of fluid between the lungs and the pleura). All of these conditions can make it harder to breathe.

Harmed by Asbestos Exposure?

Many victims of asbestos disease and their families are entitled to receive asbestos exposure compensation because manufacturers of asbestos-containing products often knew about the dangers of asbestos.

In fact, asbestos has been linked to cancer as early as the 1930s. The evidence shows that these companies did not advise workers of the potential hazards of their products, nor did they make any effort to put warning labels on the products to inform workers of the dangers of asbestos.

As a result of this failure to warn, hundreds of thousands of workers have developed asbestos-related diseases over the past century. Many have died. Bringing legal action against these companies is one remedy available to you.

Asbestos Exposure Lawsuits in Florida

Asbestos Exposure Lawsuits and Claims

Asbestos is a silent killer. Millions of American workers were exposed over the years and never warned about the dangers. There is no “safe” level of exposure to asbestos. Any exposure at all means a higher risk of getting an asbestos-related disease during your lifetime. Symptoms can take decades to develop. You or your family could be eligible for a settlement from an asbestos trust fund or through litigation.

File a Claim with an Asbestos Trust Fund
Asbestos trust funds allow victims to file a claim for compensation through the trust instead of using the company.  The compensation applies to all types of asbestos-related illnesses.

There are about 60 trust funds currently in existence with an estimated $30 billion available to compensate victims. About $20 billion has already been paid out. This money is subject to a statute of limitations, which changes with each specific trust fund.

Are You Eligible for an Asbestos Trust Fund Settlement?

Find out with a free attorney case review

Filing an Asbestos Lawsuit

People who are not eligible for a trust fund settlement have the option of litigation. There are two main types of lawsuits you can file in asbestos litigation: Personal Injury and Wrongful Death.

Personal Injury Lawsuit for Asbestos Exposure

You can file a pesonal injury lawsuit against the company responsible for your asbestos-related disease. Asbestos victims can seek compensation for cancer treatments, home health aides, and medical devices. Victims can also receive lost income related to their illness and treatment travel expenses.

Wrongful Death Lawsuit for Asbestos Exposure

The estate of a person who has died from mesothelioma can file a wrongful death claim. Survivors can seek compensation for medical bills, funeral expenses, and lost income.

Statute of Limitations

It is vital to file a claim as soon as possible. Statutes of limitations set a time limit to file a lawsuit, typically about two years after an asbestos-related disease is diagnosed or a victim passes away. However, the statute of limitations varies by state. The victim may have anywhere from 1 to 4 years to file a claim. In the case of a Wrongful Death Lawsuit, the window begins on the day of the victim’s death. That’s why it is vital to contact an attorney with mctlaw right away after diagnosis or death.

What is Asbestos?
Asbestos is a mineral mined from the earth that is toxic to people exposed to it. It’s been used for decades because of its heat resistance and strength under tension. Despite the dangers of asbestos, it is still mined used in many products today.

Who is Most at Risk for Asbestos Exposure?

People most at risk and with the heaviest exposure to asbestos worked in asbestos industries like shipbuilding and insulation. Also at risk are factory workers who worked in factories where asbestos was present.

Those worker’s family members were also exposed to high levels of asbestos because fibers were brought home on the worker’s clothing, then inhaled by everyone inside the home.

US Occupational Health and Safety Administration (OSHA) estimates more than a million American workers in construction and industries face significant exposure to asbestos on the job today.
